These Terms and Conditions ("Terms") govern your access to and use of 30Journeys, a marketing reporting and project management platform ("Platform") developed and operated by NIVIDA Web Solutions Pvt. Ltd. ("NIVIDA", "we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using 30Journeys, you confirm that:

• You are at least 18 years of age.
• You have the authority to enter into these Terms on behalf of yourself or the organization you represent.
• Your use of the Platform complies with all applicable laws and regulations.

2. Description of Service

30Journeys is a SaaS-based platform designed for digital marketing agencies and businesses to manage and report on:

• SEO (Search Engine Optimization) activities and reporting
• SMO (Social Media Optimization) activities and reporting
• PPC (Pay-Per-Click) campaign reporting
• Backlink management and tracking
• Client and project management
• Team activity logs and attendance tracking
• Lead management and conversion tracking
• Standard Operating Procedures (SOPs)

3. Account Registration and Security

To access the Platform, you must register for an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the security and confidentiality of your login credentials.
• Immediately notify us of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.
• Not share your account credentials with unauthorized third parties.

NIVIDA reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription and Payment

Access to 30Journeys may be subject to subscription fees. By subscribing:

• You authorize us to charge the applicable fees for your selected plan.
• Subscription fees are billed in advance on a monthly or annual basis as selected.
• All fees are non-refundable except as specified in our Refund Policy.
• We reserve the right to modify pricing with 30 days' prior notice.
• Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree to use the Platform only for lawful purposes. You must NOT:

• Upload, store, or transmit any unlawful, harmful, defamatory, or fraudulent content.
• Attempt to gain unauthorized access to any part of the Platform or its systems.
• Use the Platform to distribute spam, malware, or harmful software.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Use automated tools (bots, scrapers) to access or extract data from the Platform without written consent.
• Resell, sublicense, or commercially exploit the Platform without our written authorization.
• Interfere with the integrity or performance of the Platform.

6. Intellectual Property

All intellectual property rights in the Platform — including software, design, logos, trademarks, and content — are owned by NIVIDA Web Solutions Pvt. Ltd. or its licensors. These Terms do not grant you any rights to use NIVIDA's trademarks, logos, or proprietary materials.

You retain ownership of all data and content you upload to the Platform. By uploading content, you grant NIVIDA a limited, non-exclusive license to use such content solely to provide and improve the service.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms. You are responsible for ensuring that any personal data you upload or process through the Platform complies with applicable data protection laws.

8. Organization and Multi-User Access

If you register on behalf of an organization:

• You represent that you have authority to bind the organization to these Terms.
• The organization administrator is responsible for managing user access and permissions.
• All users within an organization are bound by these Terms.
• NIVIDA is not responsible for disputes between an organization and its users.

9. Third-Party Integrations

The Platform may integrate with or link to third-party services. These integrations are provided for convenience and NIVIDA is not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Disclaimers and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

• NIVIDA makes no warranties, express or implied, regarding the Platform's fitness for a particular purpose, accuracy, or uninterrupted availability.
• NIVIDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
• Our total liability to you shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless NIVIDA Web Solutions Pvt. Ltd., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate the agreement at any time. Upon termination:

• Your access to the Platform will be immediately suspended.
• You may request export of your data within 30 days of termination.
• NIVIDA may delete your data 90 days after termination.
• Provisions that by their nature should survive termination will remain in effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India. We encourage you to contact us first to resolve disputes amicably.

14. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Platform after changes constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Platform.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
